These are the official rules that govern the operation of the #CuriosityBirthdaySelfie Giveaway (the “Giveaway”). To participate in this Giveaway, take a selfie photo of yourself celebrating the 5^th anniversary of the Curiosity rover’s landing on Mars. The photo that you share via one of three social media channels, Instagram, Twitter, or Facebook, to enter the Giveaway will be called a “Submission.” Each account holder of a social media account who enters a Submission will be called an “Entrant.” Entry eligibility will be determined using the criteria described below.

This Giveaway is sponsored by the Space Foundation (“Sponsor”) and is in no way sponsored, endorsed or administered by, or associated with Instagram, Twitter, or Facebook. Void where prohibited by law or where prior registration or approval is required, including, but not limited to, Arizona, Puerto Rico and other U.S. territories or possessions.

Giveaway Timing: There is one total giveaway. The Giveaway (via Facebook, Twitter or Instagram) begins at 12:00 am (EST) on July 5, 2017, and ends at 11:59 pm (EST) on August 5, 2017 (Submission Period). Sponsor will notify the winning Entrant by sending a direct message to the social media account used by Entrant to make the Submission. To claim the prize, each winning Entrant must provide Sponsor with the information described in section 5. below and respond to Sponsor’s direct message within 7 days providing the address to which the prize should be mailed. Prizes may also be picked up by the winner at the Space Foundation with appropriate identification.

1. ENTRY: No purchase necessary to enter or win. Entrants will enter by submitting photos via Instagram, Twitter and Facebook. During the Submission Period, submit a photo through the specified media channel:

 

a. Twitter: upload an original photo to your Twitter account, attach it to a tweet containing the hashtag #CuriosityBirthdaySelfie and containing the tag @SpaceFoundation. In order for your Submission to be entered and validated, your Twitter profile settings must be public.

b. Instagram: upload an original photo to your Instagram account and add the hashtag #CuriosityBirthdaySelfie and the tag @SpaceFoundation. In order for your Submission to be entered and validated, your Instagram profile settings must be public.

c. Facebook: upload an original photo to Space Foundation’s Facebook page and add the hashtag # CuriosityBirthdaySelfie and the tag @SpaceFoundation. In order for your Submission to be entered and validated, your Facebook settings must be public.

2. ELIGIBILITY: This giveaway is open only to legal U.S. residents, over the age of 18. Employees of The Space Foundation (along with its contractors, affiliates and subsidiaries) and their families are not eligible. Void where prohibited by law. Entrants residing in those areas where the giveaway is void may participate in the giveaway but may not win any prizes.

 

3. WINNER SELECTION: Winning Submission will be chosen by the Space Foundation panel.  Winners will be notified AFTER August 15, 2017.

 

4. PRIZES: Winners will receive a Space Foundation gift bag filled with Space Foundation swag, two (2) SpaceX model rockets, a stuffed Mars, and two (2) Space Foundation “Astronaut In Training” t-shirts. Prizes valued over $100.

 

5. WINNER NOTIFICATION: Winners will be notified within 14 days after the determination date. Inability to contact a winner may result in disqualification and selection of an alternate winner.

If your Submission wins, each and every recognizable person in your winning Submission’s photo will be required to provide a Subject’s Publicity and Intellectual Property Release and Liability Waiver (“Subject’s Release”), a copy of which is available here. If a recognizable person in your winning Submission’s video is under age 18, the Subject’s Release must be signed by such person’s parent or legal guardian. The signed Subject’s Release should be submitted by attaching them to an email sent to “[email protected],” or sending them via U.S. Mail or other carrier to:

6. GENERAL CONDITIONS:

 

a. Participants hereby grant the Space Foundation a non-exclusive, perpetual, worldwide license to broadcast, publish, store, reproduce, distribute, syndicate, and otherwise use and exhibit the Submission (along with their names, voices, performance and/or likenesses) in all media now known and later come into being for purposes of trade or advertising without further compensation. Participants represent and warrant that they have full legal right, power and authority to grant the Space Foundation the foregoing license and if applicable, have secured all necessary rights from any participants in, and contributors to, their Submission in order to grant such a license.

 

b. The Space Foundation is under no obligation to use any Submission or return the Submissions to participants.

 

c. Winners will be required to execute and return a Certificate of Eligibility, Consent and General Release form within 14 days of notification. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Any income tax liability is the sole responsibility of the winner.

 

7. USE OF GIVEAWAY INFORMATION: All entries become the property of the Space Foundation. The Space Foundation reserves the right to use any and all information related to the giveaway, including submissions provided by the entrants, for editorial, marketing and any other purpose, unless prohibited by law.

 

8. NOT ENDORSED BY FACEBOOK, TWITTER OR INSTAGRAM: By participating in this giveaway, you acknowledge that this giveaway is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram and release Facebook, Twitter and Instagram from any and all liability arising from or related to this giveaway. The information you are providing for this giveaway is being provided to the Space Foundation and not to Facebook, Twitter or Instagram, and will be used to notify you if you have won, and to inform you about special offers from the Space Foundation and our trusted partners.

 

9. CONDUCT: All giveaway participants agree to be bound by these Official Rules. The Space Foundation in its sole discretion reserves the right to disqualify any person it finds to be tampering with the entry process, the operation of its web site or is otherwise in violation of these rules.

 

10. LIMITATIONS OF LIABILITY: The Space Foundation is not responsible for late, lost or misdirected Submissions or for any computer, online, telephone or technical malfunctions that may occur. If for any reason, the giveaway is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, the Space Foundation may cancel, terminate, modify or suspend the giveaway. Entrants further agree to release the Space Foundation from any liability resulting from, or related to participation in the giveaway.

HOW TO OBTAIN A SUBMISSION WITHOUT PURCHASE: No purchase is necessary to obtain a Submission. There are three ways to obtain a Submission: (1) pay Space Foundation Discovery Center entrance fee, take a selfie with the in-house props and submit the requested photo through the appropriate social media site. (2) Print one of the documents on this webpage and take a selfie with it and submit the requested photo through the appropriate social media site. (3) request a free Submission by sending a self-addressed stamped envelope to: #CuriosityBirthdaySelfie, Space Foundation, 4425 Arrowswest Dr., Colorado Springs, CO 80907. There is a limit of ONE Submission you can request by mail, per Giveaway. All requests must be postmarked no later than August 5, 2017, and received by August 15, 2017. A purchase will not improve chances of winning.
